Terms and Conditions
Booking of any of the programs or services in this website means a full acceptance of these General Conditions that automatically will be incorporated into the contract, without requiring the written transcript of it.
In this Website it is indicated the duration, itinerary, prices and extras, minimum and inclusive group travel.
Additional information and any changes will be communicated to the customers along with the written itinerary, which, together with the General Conditions, act as the final contract.
The technical organization of these trips is provided by Wellness Retreats lnc. in collaboration with PT. Putra Sari Abadi located at Perum. Multi Permai Sading – Badung – Bali, Indonesia.
Wellness Retreats, Inc may unilaterally change without notice, whenever it deems appropriate, the structure and Website design, as well as modify or eliminate services, content and conditions of access and / or use of the Website.
Content of the Website
It is not allowed the reproduction, distribution or modification of text, photographs or any graphics and sound files without express written permission of Wellness Retreats, Inc
Prices are quoted in USD$ or in Indonesian Rupiahs IDR.
The package price does not include: plane ticket, visas, airport taxes, and / or entry and exit rates, vaccination certificates, “extras” such as coffees, wines, spirits, mineral water, special diets – even in cases full board or half board, unless expressly agreed otherwise in the contract – washing and ironing clothes optional hotel services, and in general, any other service not specifically listed in “The trip price includes” or not stating specifically detailed in the program / offer, the contract or the documentation provided to client.
The price may be increased for the following reasons:
-A strong fluctuation of the currency (USD$ – Rupiah)
-An unexpected increase or imposition of new taxes
-A sharp increase in fuel prices
-The availability on room category offered in the programs
Prices are not guaranteed until the total amount of the invoice has been paid for in full and issued, and are subject to change at any time until then.
Wellness Retreats, Inc. reserves the right to review the prices of the programs offered up to 20 days before the arrival of participants to Indonesia.
Transport and excursions are made in private vehicles with air conditioning except in those programs which by its nature is not possible and are Jeep 4×4 vehicles.
All programs include transportation between airports and hotels in air-conditioned vehicle without necessarily being assisted by local English speaking staff. Sometimes these transfers may be made by the vehicles of the hotels themselves.
At the end of Ramadan holiday and some Hindu ceremonies, traffic increases considerably around the island and it might influence the scheduled visits.
To ensure the hotel spaces and rooms, reservations must be made at least one month in advance with all the possible specifications (type of room, customer name, number of beds, etc.)
Cancellations must be made with four weeks in advance to apply the relevant cancellation fee. The hotel rooms provided in the programs will be standard category unless it is indicated something different.
Some hotels may require a cash deposit or the number of credit card at the time of registration; this amount will be refunded when leaving the hotel.
The beds in triple rooms in some hotels are limited to a mattress with no bed or collapsible bed.
The guides include in our visits and programs in Bali are English-speaking. If you wish to have a guide that speaks a different language you must request in advance and extra charges may be applied.
Wellness Retreats, Inc. is not responsible for any loss or damage during travel or transportation.
Reservations and confirmations
Reservations must be conducted by email accompanying the same as many data as possible. Customer name (as presented in the passport), arrival and departure date, program name, number and type of beds.
To book a program, hotel and other services a deposit of 30% of the total amount must be done unless certain supplier requests a different anticipated amount or percentage. No reservation will be done until this deposit is not formalized. The rest of the payment will be done at least 45 days before the arrival date in Indonesia; otherwise we will consider that booking can be cancelled. Such cancellation will involve expenditure in the cancellation section of this clause.
Wellness Retreats, Inc. will send by email the confirmation no later than three days before the arrival of guests.
Cancellations and Refunds
In the event of cancellation by the client of a program or services previously engaged shall be paid as a penalty the following amounts:
A. 30% of the total amount if the cancellation occurs between 90 and 45 days before arrival.
B. 75% between 45 and 31 days before arrival.
C. 100% 30 days prior to arrival, no-shows or late arrivals.
Unless stated otherwise.
These amounts will be deducted from the deposit paid and the customer will pay the cancellation costs if there was any (like non-refundable tickets or hotel services which would involve prepayments and no possibility of refund) and management costs.
During the months of June, July, August, September, December and January and a week after the end of Ramadan, most hotels in Indonesia do not refund deposits made in case of cancellation of bookings.
Regardless of these penalties, Wellness Retreats, Inc. may require payment of managing costs and cancellation fees applied by tourism accredited suppliers through invoices (non-refundable reservations or deposits, visas costs, etc.).
In the case of reimbursement costs for international transfer will be paid by the customer.
When the cancellation causes that the group falls below the minimum number of people required, Wellness Retreats, Inc. may charge the client, the proportional share for the group costs of the program.
Once the program has commenced the no use or enjoyment of certain services previously contracted as excursions, therapies, consultations, meals or hotel nights, etc. are not refundable.
In the event that a cancellation causes the annulment of the contracted services that were subject to a minimum number of participants, the user is entitled the reimbursement of the total price or advance payments without being able to claim any other amount for compensation. Transfer expenditure if any will be assumed by the customer.
There is no obligation to indemnify under the following circumstances:
1. When the cancellation is due to that the number of people registered for the program is lower than required, and so it is notified by mail to the user before the deadline to do so reflected in the contract.
2. When the program is canceled, except in cases of overbooking, if it is for act of God, meaning such circumstances are beyond the party concerned, and abnormal consequences that would have been unavoidable, despite having acted with due diligence.
The Company as an intermediary and Wellness Retreats, Inc. only acts as an intermediary between the Client and the Suppliers, and accordingly on receipt by the Company of any request for a booking(s) in a brochure or tailored quote. The Company shall transmit any such booking to the Suppliers concerned and endeavor to secure timeously all reservations and arrangements.
Wellness Retreats, Inc. does not accept liability to the Traveler for any actions, errors or omissions of the Suppliers and/or their agents, which may be prejudicial to the Client or result in loss in any way or form whatsoever, including injury, illness, harm, trauma, death and/or loss of or damages of whatsoever nature or kind and the Client indemnifies the Company accordingly.
Any right of recourse the Client may have, will be solely against the Suppliers.
All visitors, without exception, must have their documentation in order, remaining under their own responsibility for any problems or inconveniences that may arise. The cost for obtaining a passport or visa will be paid by the customer unless expressly agreed in the contract something different for the visa. If any authority refuses to issue a visa for the client’s personal issues, or if it is denied the entry into Indonesia by lacking any requirement, Wellness Retreats, Inc. disclaims any responsibility and any costs arising that shall be assumed by the user.
Most citizens can obtain a visa that on arrival (please, confirm conditions and requirements at the Indonesia’s consulate at your country of residence). You must request the appropriate visa to the number of days you will stay in Indonesia and according to the purpose of your visit, among other factors. Passports must be valid at least for 6 months from the date of entry into Indonesia.
Wellness Retreats, Inc. do not act as lawyers, and nothing said by Wellness Retreat s, Inc. should be interpreted as legal advice concerning visas, entry requirements, immigration or residency.
In case of loss of documentation and vouchers, the replacement of these by Wellness Retreats, Inc. will have a cost of $50.
Some activities due to specific characteristics such as diving, cruising and trekking, have special conditions. We have additional information that will be provided to customers prior to enrollment.
-30% of the total amount should be paid at the time of confirming availability of services required, and 70% remaining 45 days before the arrival to Indonesia.
For cases of groups this amount should have been transferred two months before arrival.
Payments will be made by bank transfer.
If any payments are made by Visa or Master Card there will be an increase of 3% on the price of the program and if any payments are made by Paypal there will be an increase of 4% on the price of the program in respect of charges.
Contracted programs do not include health, medical evacuation or repatriation insurance. We recommend our clients to obtain before departure from their origin travel insurance with coverage in Indonesia.
For many trekking and diving activities require to have insurance that cover trekking and diving.
We recommend purchasing optional insurance that covers the totality of possible cancellation fees. Prices varies depending on the price of travel booked. This kind of insurance usually guarantees the reimbursement of trip cancellation in case of serious illness, serious injury or death of the insured person, his spouse, ascendants or descendants, brothers or sisters and also in cases such as layoff, serious damage of normal place of residence and other specific issues described in the insurance guarantees contracted.
Wellness Retreats, Inc. acts as an agent for hotels and other services provided, so Wellness Retreats, Inc. is not responsible for any loss, damage, delays, accidents, program changes or irregularities that are beyond our control.
Therefore, Wellness Retreats, Inc. assumes no responsibility for the shortcomings that could have the services provided by such entities or persons.
Wellness Retreats, Inc. do not assume the costs of cancellations or delays of flights, trains and boats for breakdowns, strikes, controls by the authorities, accidents, traffic etc. and loss of connections both domestic and international flights and services derived by excessive traffic, especially during the end of Ramadan and local and national holidays.
In case of a delay in departures or returns of any means of transport attributable to strikes, weather conditions, technical problems or an act of God, Wellness Retreats, Inc. undertakes to take all reasonable steps at its disposal to assist customers affected by these types of situations, providing that costs of these actions are equal to or below the price paid for the program.
Wellness Retreats, Inc. reserves the right to alter the order of the path of any itinerary, planned hotels, transportation and other services described in this program, change the start time and even cancel the trip, whenever there is any major reasons for it, in which circumstances the client is entitled to claim no more than the amounts paid if not agreed with these conditions.
In the case that, once the program has already begun, Wellness Retreats, Inc. can not provide an important part of the contracted services, it will adopt the most suitable solution to continue with the tour and program. Wellness Retreats, Inc. will pay the amount for the difference between the services offered and the ones provided. If the participant continues the program under these new conditions, it will be deemed tacitly that user accepts such proposals.
Wellness Retreats, Inc. declines to accept any responsibility for the services provided by other agents, hotels or activities contracted by Wellness Retreats, Inc. on request by the client.
The delay, schedule changes and flight cancellations are common place in Indonesia. For this reason it is important the group’s flexibility in terms of possible changes and alterations of the program.
Wellness Retreats, Inc. understands that when client participate in programs focused on hiking or trekking, rafting and diving sports, the customer has received proper training and possess the necessary qualifications to practice these activities, as well as accident insurance covering the activities to be performed. In some cases these activities have a high component of adventure with a higher risk than usual because it takes place outside the usual tourist circuits and sometimes in the forest and with direct contact with wildlife and tropical diseases. The customer assumes these risks and obligations in full knowledge of the facts and agrees not to put the responsibility on Wellness Retreats, Inc. and their agents.
The user must immediately inform the supplier of services and within the next 48 hours to the organizer of any incidence to make the proper actions to resolve the problem. If this period elapses it will be impossible for the agency organizing a satisfactory resolution and to confirm the veracity of the claim. Claims submitted must be documented with receipts and invoices, and must contact the organizer within 15 days after the return trip.
